TERMS AND CONDITIONS

1. WHO MAY APPLY?
Lessonz Abroad Ltd offers study abroad packages open to all people aged 11 years and above. Students must be the minimum age requirement at time of course commencement. Please check the details included in each individual package for minimum age requirements.

All students under the age of 18 who have no legal guardian permanently resident in New Zealand, must stay at Lessonz Abroad arranged accommodation in host family. Unless otherwise requested by a parent or guardian, students under the age of 18 staying in family accommodation will be expected to return to their accommodation by no later than 10pm each evening.

Lessonz Abroad Ltd has the right to refuse any application based on the package requirements if the student does not comply with the conditions required (at Lessonz Abroad’s discretion).

Please note: The student must supply Lessonz Abroad Ltd with all details of any existing health problems and medical conditions.

2. COURSE DATES
Our language school courses start from one week and may run for up to nine months. Most of our courses start each Monday but can differ depending on each individual course. Please check course start dates on each individual package.

3. TRAVEL ARRANGEMENT AND TRANSFER SERVICE
Lessonz Abroad Ltd must receive all flight details four days prior to departure. If we do not receive this information by the deadline, you will be responsible for your own transport from the airport to your accommodation.

4. HOW TO ENROL
Complete the application form, choosing your package and accommodation type. Send the form to us including the non-refundable registration fee of NZ $350.
A signature is required on the application form with a copy of your passport and visa (applicable to Working Holiday and Student visa holders).
Other documents which may be required are:
» A photocopy showing proof of payment from your bank.
» A photocopy of your insurance policy (if taken out in your country).

After confirmation of payment has been received, Lessonz Abroad Ltd will send you a receipt with school enrolment confirmation. After suitable home-stay accommodation has been selected, you will receive a host family profile, showing family member details.

Please note: Lessonz Abroad Ltd will complete the Language School enrolment form on behalf of the student. Please provide us with all the relevant information necessary.

5. HOLIDAYS
Application for a holiday from your school course must be made directly to your Language School Provider and is subject to the terms and conditions of that school.
Your accommodation is available during vacation. You therefore have the choice of a) staying with your host-family b) participating in optional school tours at an additional cost, or c) travelling independently at your own expense.

6. WHAT IS INCLUDED IN THE PRICE?

Because our packages differ depending on programme of study, accommodation and duration, please check details included in each individual package.

All Language School Enrolment and Tuition Fees are included unless otherwise stated in package details.

Please note: All course textbooks and study materials are not included in the price unless indicated otherwise.

Our welcome pack is available only to students who book a package whereby they attend a Language school in Auckland. Lessonz Abroad Ltd reserve the right to change any of the contents included in the welcome pack at any given time, without notice.

All Lessonz Abroad Ltd special offers and promotions are available only during the promotional period indicated or while stocks last and are subject to availability. Lessonz Abroad Ltd reserve the right to change any special offers and promotions at any given time, without notice.

Lessonz Abroad Ltd cannot take responsibility for any special offers or promotions offered by Language School Providers, including any changes endorsed by the Language School Providers.

a) Volunteer programme
Our volunteer service is free for any student who books a package with a minimum of 4 weeks full-time study combined with 4 weeks home-stay accommodation. Lessonz Abroad Ltd cannot guarantee volunteer work placement for all students.

b) Working Holiday Plus English (English plus job offer)

  • The student must book a minimum of 4 weeks full-time study combined with 4 weeks accommodation in host-family.
  • Employment will not be offered until such time that the student’s English ability has reached intermediate level. After being assessed, the student may be required to undertake further English classes until their English level reaches intermediate.
  • Employment may be offered anywhere in New Zealand. Students are responsible for their own accommodation and travel expenses.
  • Students can only refuse a maximum of 3 employment offers.
  • The student will be refunded while in New Zealand, a total of NZ $400, if the educational provider has not been able to offer a minimum of 12 weeks full-time employment (40 hours per week) within 4 weeks of the student’s English level being satisfactory to commence employment.
  • Lessonz Abroad Ltd and the Language School Provider cannot guarantee it will be able to find employment for the student.
  • Lessonz Abroad Ltd cannot be held responsible for any of the educational provider’s actions or decisions.

7. TERMS OF PAYMENT
All applications must be accompanied by a non-refundable Registration Fee of NZ $350. This fee covers enrolment costs and pre-departure administration costs. The outstanding balance is then due 30 days prior to course start date.
Applications received after the payment deadlines will be treated on an individual space-available basis and full payment must be submitted with the application.

8. VALIDITY OF PRICES
Prices advertised on our website and brochures are based upon currency exchange rate in effect at the time of writing (22 August 2005) and are subject to change, up to 30 days before departure.

9. METHODS OF PAYMENT
All fees must be paid in New Zealand dollars by direct/telegraphic transfer from your bank to Lessonz Abroad bank:

10. CANCELLATION POLICY
The Language Course Fee is fully refundable if you cancel before departure.
Additional refunds will be made as follows:
If you cancel before the payment deadline (see Section 7:Terms of Payment) you will receive a full refund, except for the non- refundable registration fee.
If you cancel after the payment deadline but before departure, Lessonz Abroad reserve the right to retain NZ$500 of the package fee to cover the cost of prepaid accommodation and transportation.

11. COURSE FEE REFUNDS
All course fees are converted into NZ dollars on the day of receipt and the refund is the equivalent to the NZ dollar value on the day of receipt. All applications for refunds must be accompanied by the original documents issued by the school, along the evidence that the documents were not issued to obtain a visa to come to New Zealand.
a. For courses LESS than 5 weeks: students may withdraw within the first two days of starting the course and will receive 50% refund of all fees paid.
b. For courses between 5 weeks to 12 weeks: students may withdraw within the first 5 days of starting the course and will receive 75% of all fees paid.
c. For courses MORE than 12 weeks: students may withdraw within the first 7 days of starting the course. In this case, students will receive a refund of NZ$500 or 10% of the amount paid, which ever is the lesser.
d. Otherwise there are no refunds on tuition fees.
e. Lessonz Abroad Ltd cannot be held responsible for any of the educational providers actions or decisions.

12. HOMESTAY CANCELLATION
Accommodation changes after your arrival are subject to a fee and require the approval of the Director of Lessonz Abroad Ltd.
All cancellations, withdrawals or changes should be submitted in writing at least 2 weeks in advance and must be confirmed by Lessonz Abroad Ltd. Non confirmed withdrawals result in payment of two weeks home-stay fee.

Please note: If less than two weeks written notice has been submitted, students still remain responsible for and must pay the two weeks home-stay fee.

Lessonz Abroad Ltd reserve the right to move a student without notice from home-stay accommodation, if Lessonz Abroad Ltd believes it is in the best interests of the student or the host family.

All Lessonz Abroad Ltd host families undergo a police vetting procedure and must comply with the Code of Practice.
Lessonz Abroad Ltd cannot be held responsible for any misconduct, injuries or accidents caused by or which may occur under the supervision of any host family member.

13. LATE ARRIVALS, ABSENCES, COURSE CHANGES AND PUBLIC HOLIDAYS
No refund will be granted if you arrive late to, or are absent during your course. Periods of absence may not be made up with free extension of the Language School course or package.
Students cannot change their course to a lower specification once the course has begun, e.g. students cannot change from a full-time course to a part-time course once they have started their course. Language School Course changes and Mid-programme school transfers are subject to a fee and space availability.
No compensation is given for days the school is closed during public holidays.
Please note: The Academic School Year Package has set starting and finishing dates with no course changes permitted.

14. PROTECTION FOR OUR CUSTOMERS
Lessonz Abroad Ltd agree to comply with the New Zealand Code of Practice for the Pastoral Care of International Students.
Our educational providers are signatories to and have agreed to observe the Code of Practice for the Pastoral Care of International Students. Copies of the code are available on request from Lessonz Abroad Ltd or from the New Zealand Ministry of Education website at: www.minedu.govt.nz

15. STUDENT FEES PROTECTION POLICY
All student’s fees are protected by student-based insurance companies arranged by their Language School Provider. In the event of insolvency, regulatory closure or withdrawal, or partial withdrawal of accreditation, Lessonz Abroad Ltd and/or the student may apply for a refund of unused fees.This arrangement has been accepted by the New Zealand Qualifications Authority in conjunction with the requirements of the Student Fee Protection Policy. 16. STUDENT COMPLAINTS
If students have any complaints about their Language School Provider:
a. Students should first complain to their teacher.
b. If necessary, students can later approach the Director of Studies.
c. If necessary, students can later approach the School Director.
d. If necessary, students can later approach the Federation of Independent English Language Schools (FIELS) PO Box 2577 Auckland.
e. If necessary, students can later approach the New Zealand Qualifications Authority (NZQA) PO Box 160 Wellington Ph 0800 72 4557 or e-mail helpdesk@nzqa.govt.nz
f. If necessary, students can later approach the International Education Appeal Authority, Ministry of Education, PO Box 1666, Wellington.
If students have any complaints about their home-stay
accommodation:
a. Firstly, approach your host mother or father and try to discuss the problem in a calm and polite manner.
b. If necessary, students can approach one of Lessonz
Abroad staff who will work as a mediator between the student and the host family.
c. If no solution can be reached successfully, the student will be transferred to another host family residence.

If students have any complaints about Lessonz Abroad Ltd:
a. Firstly, approach one of Lessonz Abroad Ltd staff and explain your concerns.
b. If necessary, students can put their concerns into writing and forward it to the Director of Lessonz Abroad Ltd.
c. In the last resort, all disputes will be resolved under the New Zealand Law or by New Zealand jurisdiction.

17. IMMIGRATION
Full details of visa and permit requirements, advice on rights to employment in New Zealand while studying, and reporting requirements are available through the New Zealand immigration Service, and can be viewed on their website: www.immigration.govt.nz

18. MEDICAL/TRAVEL AND ACCIDENT INSURANCE
Students must have Medical and Travel Insurance from the date of their departure from their native country to the date of their return. If students arrange their own insurance, they must provide a copy of their insurance policy on their first day of school. The insurance policy must be from a reputable and established Travel Insurance Company, with a credit rating no lower than A from Standard & Poors, or B+ from AM Best. The insurer must provide emergency 24hour/7 day per week insurance cover.
The student must provide details of what the insurance covers and provide the dates of the insurance cover.
Although it is the responsibility of the student to arrange their own personal insurance, Lessonz Abroad Ltd can provide information about and arrange an insurance policy, only if the student is attending a language school included in one of Lessonz Abroad Ltd packages.

The Accident Compensation Corporation provides accident insurance for all New Zealand citizens, residents, and temporary visitors to New Zealand, but you may still be liable for all other medical related costs. Further information can be viewed on the ACC website at: www.acc.co.nz

19. LIABILITY
Lessonz Abroad Ltd, New Zealand promotes Language Study Programmes supplied by a number of high-quality Language School Providers.
In addition, we arrange various types of accommodation including home-stay, apartments and backpackers.

Lessonz Abroad Ltd cannot be held responsible for any sickness, injury, damage or loss to persons or property incurred within the school or on school activities.
If the weather is unsuitable for any school activity (at the schools’ discretion), an alternative activity will be arranged (at the schools’ discretion). There are no refunds for cancelled/alternative activities.

Lessonz Abroad Ltd cannot be responsible for any Language School Providers misconducts or school closures. In such circumstances, Lessonz Abroad Ltd fees are not refundable.

Please refer to COURSE FEE REFUNDS (Section 11) for your tuition fee refunds.
Lessonz Abroad Ltd will not be liable in any way to the student for any service, contracted to be supplied by Lessonz Abroad Ltd, becoming impossible to supply by reason of industrial dispute or other cause outside the control of Lessonz Abroad Ltd.
Lessonz Abroad Ltd will not be liable for loss, damage, or injury to persons or property howsoever caused, save where the liability is expressly imposed beyond exclusion of statute.

20. ACCIDENTS AND EMERGENCIES
The Language School Staff are responsible during any accident or emergency. The school staff instructions must be followed. The school will take necessary action in the case of any sudden illness or emergency.

21. PRIVACY ACT
In terms of the Privacy Act, information is collected as part of the essential information Lessonz Abroad Ltd and the Language School Provider holds on the student. The records made from this information may be viewed on request. Lessonz Abroad Ltd and the Language School Provider may transfer this information to other educational authorities or immigration services.

22. GOVERNMENT TAXES
Please note that all Language School Courses and Lessonz Abroad Ltd service fees include 12,5% Goods and Services Tax (GST). Should this be increased, our fees will increase accordingly.

Home-stay accommodation is exempt from GST.

Language School Providers must charge International Students (except for Exchange Students) a Government
Levy Fee to cover all expenses, including course fees, tuition, and administration costs. This fee is included only in
Lessonz Abroad Ltd packages where students are enrolled in a Language School Course.

23. PERSONAL LIABILITY
The Law concerning personal liability in New Zealand is entirely contained in the Accident Compensation Act of 1982. No personal injury claim can be made against Lessonz Abroad Ltd or any other company, organisation or any individual. Further information can be viewed on the ACC website at: www.acc.co.nz

24. CONTACT DETAILS
Students must advise Lessonz Abroad Ltd of all changes to: contact details, accommodation type and residential address.

25. FIRST DAY AT SCHOOL
Students will not be permitted to commence their studies unless they provide the Language School Provider with a copy of their passport and insurance policies. Students should also bring a passport photo for school student card.

26. CHANGEMENT OF AGENT
Students, who wish to change their agent but want to continue their course, will have to pay a new Registration Fee and new Government Levy (if applicable) to the Language School Provider.
Lessonz Abroad Ltd service fees will not be refunded.
